Similarly, the European Patent Office permits AI inventions when they contribute to a technical answer beyond a purely mathematical method. These evolving international practices highlight the growing recognition of AI as a field deserving robust intellectual property protection while maintaining safeguards against monopolising abstract ideas.
Another emerging legal debate issues AI-generated inventions. Traditionally, patent laws recognise only natural persons as inventors. This issue gained international attention through the DABUS cases, where an AI system was named as the inventor in patent applications. Patent offices in several countries, including India, the United Kingdom, the United States, and the European Patent Office, rejected these applications on the ground that prevailing laws need a human inventor. These decisions have sparked discussions about whether patent laws should evolve to settle inventions autonomously created by AI systems.
For innovators and businesses, securing patent protection gives several commercial advantages. Patents create a competitive edge, attract investors, facilitate technology licensing, enhance business valuation, and encourage collaborative research.
